Depending on the specific purposes and grounds, \u201eESKAPE TOUR\u201d Ltd. processes the data specified below, either individually or in combination with each other, namely:<\/p><ol><li>The data provided by you, necessary for identification and the fulfilment of reservations made and confirmed by you for our accommodation complex, such as:<\/li><\/ol><ul><li>three names, phone number and\/or email address to contact you, or a nominated contact person, date and time of arrival and departure, children and their ages;<\/li><li>data collected during payment made to us \u2013 credit or debit card number, bank account and other information collected and processed in connection with payments made by bank transfer, direct debit or via POS terminal of ESCAPE TOUR LTD;<\/li><li>your profile data for accessing our online booking platform \u2013 username, booking history, and payments;<\/li><li>data on the services you have used and the information received through them regarding your preferred destinations and services offered by us;<\/li><li>Other data that you provide us in connection with services already used.<\/li><\/ul><ol><li>Data provided by you and stored by ESCAPE TOUR Ltd. in the process of providing accommodation services on-site in our apartments, which data is collected, processed and stored in accordance with the current regulatory requirements regarding the keeping of a register of accommodated tourists by persons carrying out accommodation activities, namely:<\/li><\/ol><ul><li>Full name; National ID Number (for Bulgarian citizens) or Foreigner ID Number (for foreign citizens with a residence permit in BG), or date of birth (in all other cases); \u00a0<\/li><li>Floor; \u00a0<\/li><li>Nationality;<\/li><li>ID card number\/valid national identity document, issuing country of the national document.<\/li><\/ul><ol><li>Others<\/li><\/ol><ul><li>Digital data \u2013 video recordings. This is the data collected through the video surveillance systems used by \u201eESKEI TOUR\u201d Ltd. in all publicly accessible areas of our accommodation facility, for the purpose of security, monitoring, control, and protection of public order;<\/li><li>IP address when visiting our website\/online booking platform,<\/li><li>Data in connection with a claim lodged regarding a tourist service provided by us and used by you;<\/li><li>Information about the type and content of your booking, as well as any other information related to it, including emails, letters, requests, applications, appeals, complaints, and other feedback we receive from you.<ul><li>Purposes and legal bases for processing personal data:<\/li><\/ul><\/li><\/ul><p>The primary legal basis for processing and storing personal data is the performance of a contract to which the data subject is party, or to take steps at the request of the data subject prior to entering into such a contract. At the same time, the processing of certain personal data is necessary for compliance with the company's legal obligations under the Tourism Act, the Civil Registration Act, the Accounting Act and other applicable regulations, as well as for the protection of the legitimate interests of the controller or a third party, such as:<\/p><ol><li>We process and store personal data that is minimally necessary and legally required for the purpose of providing accommodation and tourist services, as well as for all other services provided on-site in our apartments, such as:<\/li><\/ol><ul><li>Identification of the customer when: making, amending, and cancelling a booking, as well as when providing accommodation tourist services, and all other services provided on-site. Customer identification is carried out through all commercial and communication channels by providing an identity document, by phone, on our online platform via an electronic contact form, by email, etc.;<\/li><li>Updating your personal details or information about services you use at the complex upon your request for correction\/amendment of data\/services;<\/li><li>Customer service and responding to customer complaints\/enquiries\/grievances. Adjustments to amounts due on already completed accommodation bookings where justified.<\/li><\/ul><ol><li>In fulfilment of its legal obligations, \u201eESCAPE TOUR\u201d Ltd processes your data for the following purposes:<\/li><\/ol><ul><li>Providing information to the Ministry of Interior, the competent municipality where the apartments are located, the Commission for Consumer Protection and the Commission for Personal Data Protection, in connection with the performance of our obligations as providers of accommodation services, arising from the applicable legal regulations in this area; \u00a0<\/li><li>processing your data on invoices issued in your name for other purposes compatible with the original purpose of its collection;<\/li><li>Carrying out tax and social security control by the relevant competent state authorities;<\/li><li>Providing information to the court and third parties in court proceedings, for the purpose of protecting legitimate interests, including the collection of claims from clients through legal action.<\/li><\/ul><ol><li>\u201eESCAPE TOUR\u201d Ltd. processes your data for the purposes of our following legitimate interests:<\/li><\/ol><ul><li>for the purposes of direct marketing \u2013 sending offers containing information about our current offers, promotions and discounts for accommodation and\/or changes to the terms and conditions of those already used;<\/li><li>for the inclusion of your name, photographs, videos and other data in advertising brochures, website and other publications of \u201eESKAPE TOUR\u201d Ltd. as a result of your participation in group events and activities organised by us.<\/li><li>for the protection, exercise or preservation of the legal rights, privacy, safety or property of the administrator, users of the administrator's services and members of the public.<\/li><\/ul><h3>3. Third-party categories that access and process your personal data:<\/h3><p>In connection with carrying out our activities and fulfilling our contractual commitments to our clients, we provide your data to the following groups of individuals, \u201erecipients\u201c, namely:<\/p><ul><li>to the data subject \u2013 whenever they exercise this right;<\/li><li>to the users\/customers to whom the data relates;<\/li><li>for business partners \u2013 for the purposes of fulfilling your bookings: travel agents and representatives in Bulgaria and abroad, transport companies and airlines, suppliers of relevant main and additional tourist services, and other subcontractors with whom we have concluded contracts;<\/li><li>Payment service providers for online payments by credit\/debit cards;<\/li><li>insurance companies when reporting an insured event with a tourist staying at our complex;<\/li><li>IT companies supporting our information systems, corporate website, software and booking management platforms for our clients, etc.;<\/li><li>to public authorities (Ministry of Interior, municipality, National Revenue Agency, Commission for Consumer Protection, Commission for Personal Data Protection, judicial and other control bodies);<\/li><li>Other personal data administrators to whom ESCAPE TOUR Ltd. provides your personal data on a legal basis and\/or based on a bilaterally signed contract.<\/li><\/ul><p>We may have to disclose your personal data \u2013 by law, in the event of litigation and\/or at the request of public and governmental authorities in or outside your country of residence, as well as for national security, law enforcement or other matters of public importance, when such disclosure is necessary or appropriate.<\/p><p>We may also disclose information about you if we determine that such disclosure is reasonably necessary to enforce our terms and conditions, or to protect our activities, legitimate interests, and the rights and legitimate interests of other users. Furthermore, in the event of a reorganisation, merger or sale, we may transfer any and all collected database to the relevant third party successor.<\/p><h4>4. Retention Period of Your Personal Data. Security:<\/h4><p>The length of time your personal data is stored depends on the purposes for which it was collected and processed.<\/p><ul><li>Your personal data, processed for the purpose of providing and fulfilling accommodation services at our complex, will be stored for a period of up to 3 (three) years from the date of your departure from the hotel, as well as until the final settlement of all financial relations between the parties, observing the legally defined periods where applicable.;<\/li><li>Personal data processed for the purpose of issuing accounting\/financial documents for tax and social security control purposes, including but not limited to invoices, debit notes, and credit notes, shall be stored for at least 3 (three) years, unless applicable legislation provides for a longer period.;<\/li><li>Picture (Video recording) \u2013 up to 30 days from the creation of the recording.<\/li><\/ul><p>Personal data may be stored for longer periods to protect the legitimate interests of \u201eESKAYP TUR\u201d EOOD, as well as until the relevant statute of limitations expires, for the purpose of protection in the event of potential customer claims related to the performance\/termination of the accommodation services provided in our apartments, as well as for a longer period in the event of an existing legal dispute \u2013 documents are stored until its final resolution by a legally binding court\/arbitral decision.<\/p><p>As a Personal Data Administrator, \u201eESKEIP TOUR\u201d Ltd. exercises due diligence and takes the administrative, technical, and physical measures required by the regulatory framework, as well as those relating to personnel (training, awareness, etc.), to protect the information it holds, including the protection of its clients' personal data from loss, theft, and unauthorised use, disclosure, modification, and any other illegal forms of processing. We have physical, electronic, and procedural safeguards that comply with our legal obligations regarding the protection of personal data, which we maintain in accordance with current technological advancements.<\/p><p>We are responsible for protecting the personal data of the client that has become known to us in connection with carrying out our activities as an accommodation complex and in providing the tourist services offered by us, specified in the subject of the General Terms and Conditions and this Policy, except in cases of force majeure, fortuitous events or malicious actions of third parties, as well as in cases where the client has made this information available to third parties themselves.<\/p><h3>5. Video surveillance<\/h3><p>The common areas of the building where the apartments are located, including the yard and stairwells, are subject to 24-hour video surveillance, which is carried out using stationary security cameras installed in the relevant locations.<\/p><p>CCTV surveillance is carried out for the purpose of protecting, exercising or preserving the legal rights, inviolability, safety or property of the controller, their employees and\/or contractors, as well as ensuring the safety, inviolability and security of our guests and members of the public.<\/p><p>The video surveillance is organised and controlled by the administrator's employees, who have received specific training in data protection.<\/p><p>Recordings are stored on video servers for a period of 30 days, except in cases of a registered violation of the rights of the administrator, tourists, or third parties, in which case the retention period of the recordings may be extended according to specific needs.<\/p><p>You have the right to request a review of records if you allege a breach of rights pertaining to you or a person for whom you have supervisory responsibility, and your request will be processed within the timeframes specified in Section 6 of this policy.<\/p><p>The company may refuse to consider requests that are unreasonably repetitive, require disproportionate technical effort, or jeopardise the confidentiality of other users.<\/p><h3>6. What are your rights concerning the processing of your personal data by ESCAPE TOUR Ltd. and what steps should you take to exercise them:<\/h3><ul><li>the right of access to data relating to him \u2013 the client has the right, at any time, to request confirmation from us as to whether data relating to him is being processed, information on the purposes of such processing, on the categories of data and on the recipients or categories of recipients to whom the data are disclosed;<\/li><li>the right to rectify and update their personal data where it is inaccurate or incomplete for the purposes for which it is processed;<\/li><li>the right to erasure (the \u201eright to be forgotten\u201c) when your data is processed unlawfully or no longer has a legal basis (the original purpose for which it was collected and processed has been fulfilled, the storage period has expired (including statutory limitation), consent to processing has been withdrawn, you have objected to its processing, etc.), there is no other legal basis for processing, or national or European legislation requires it;<\/li><li>right to restriction of processing \u2013 in the event of a legal dispute between \u201eESQUEIP TOUR\u201d Ltd. and the individual until its resolution and\/or for the establishment, exercise or defence of legal claims; where processing is unlawful, but the data subject does not wish the personal data to be erased, but instead requests restriction of their use; if you have objected to the processing of your personal data, pending the verification of its justification;<\/li><li>right to data portability \u2013 the data subject has the right to request that we transfer their personal data in a machine-readable format to another controller explicitly specified by them without hindrance;<\/li><li>Obligation to notify when personal data is rectified or erased or processing is restricted \u2013 the client has the right to request that we notify third parties to whom their personal data has been disclosed of any erasure, rectification or blocking of that data, unless this proves impossible or requires disproportionate efforts from ESCAPE TOUR Ltd.;<\/li><li>right to be notified of a personal data security breach \u2013 in cases where the data security breach is likely to give rise to a high risk to the rights and freedoms of individuals.
